1. Agreement to Terms

By accessing or using Moan Bot, including its website, Discord bot, and any related services (collectively, the "Services"), you agree to be bound by these Terms of Service (this "Agreement"). If you do not agree to all terms in this Agreement, you may not access or use the Services.

2. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on Moan Bot for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

• Modify or copy the materials
• Use the materials for any commercial purpose or for any public display
• Attempt to decompile or reverse engineer any software contained on Moan Bot
• Remove any copyright or other proprietary notations from the materials
• Transfer the materials to another person or "mirror" the materials on any other server

3. Paid Services & Premium

Moan Bot offers an optional one-time Premium purchase ("Premium") that unlocks additional features and capabilities. By purchasing Premium, you agree to the following:

• Payment: Premium is a one-time payment processed via cryptocurrency. By completing the payment, you acknowledge that you have reviewed and agree to these terms.
• No Refunds: All payments for Premium are final and non-refundable. There are no refunds or credits for any reason, regardless of the circumstances. Due to the nature of cryptocurrency transactions, chargebacks and reversals are not possible. By purchasing, you acknowledge and agree to this no-refund policy.
• Price Changes: We reserve the right to modify Premium pricing at any time. Price changes will not affect existing Premium users who have already completed their purchase.
• Feature Availability: Premium features may be added, modified, or removed at our sole discretion. We do not guarantee that any specific feature will remain available indefinitely.
• Lifetime Access: Premium is granted on a per-server or per-user basis as specified at the time of purchase. Access persists indefinitely unless revoked due to a violation of this Agreement.

4. Termination & Suspension

We reserve the right to terminate or suspend your access to our Services without prior notice, at our sole discretion, for any reason or for no reason, including but not limited to any violation of this Agreement. Upon termination:

• Your right to use the Services will immediately cease
• Your Premium access will be revoked with no refund issued
• We may delete any data associated with your account
• We are under no obligation to provide a reason for termination

If you wish to terminate your account, you may simply discontinue using the Services and remove the bot from your server. All provisions of this Agreement which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

5. Disclaimer

The Services are provided on an 'as is' and 'as available' basis. Moan Bot makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties including, without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. We do not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

6. Limitations of Liability

In no event shall Moan Bot, its operators, or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the Services, even if we or our authorized representative has been notified orally or in writing of the possibility of such damage. This includes, but is not limited to, any losses arising from the termination or suspension of your account or the modification or discontinuation of any Premium features.

7. Accuracy of Materials

The materials appearing on Moan Bot could include technical, typographical, or photographic errors. Moan Bot does not warrant that any of the materials on this website are accurate, complete, or current. Moan Bot may make changes to the materials contained on its website at any time without notice.

8. Links

Moan Bot has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Moan Bot of the site. Use of any such linked website is at the user's own risk.

9. Modifications to Terms

Moan Bot may revise these Terms of Service at any time without prior notice. By continuing to access or use our Services after those revisions become effective, you agree to be bound by the revised terms. It is your responsibility to review this Agreement periodically for changes.

10. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of the jurisdiction in which Moan Bot operates, and you irrevocably submit to the exclusive jurisdiction of the courts in that location.

11. Bot Usage

Users agree not to use Moan Bot for:

• Violating Discord's Terms of Service
• Harassment, spam, or abusive behavior
• Illegal activities
• Circumventing security measures
• Attempting to gain unauthorized access to our systems
• Sharing, reselling, or redistributing Premium access to unauthorized users
• Exploiting bugs or vulnerabilities to gain Premium features without payment

12. Lookup & Data Services

Moan Bot provides various lookup and data retrieval features (collectively, "Lookup Services"). By using these Lookup Services, you acknowledge and agree to the following:

• No Responsibility for Use: Moan Bot is not responsible for how you use, interpret, or act upon any data or information obtained through the Lookup Services. You are solely responsible for your use of any information retrieved.
• No Guarantee of Accuracy: Data returned by Lookup Services is provided "as is" from third-party sources and publicly available databases. We make no representations or warranties regarding the accuracy, completeness, reliability, or timeliness of any lookup results.
• Lawful Use Only: You agree to use Lookup Services only for lawful purposes. You shall not use any data obtained through these services for harassment, stalking, doxxing, identity theft, unauthorized surveillance, or any other illegal or malicious activity.
• No Liability: Moan Bot, its operators, and affiliates shall not be held liable for any damages, losses, claims, or legal consequences arising from your use or misuse of information obtained through Lookup Services, whether direct, indirect, incidental, or consequential.
• Third-Party Data: Lookup results may originate from third-party APIs and databases over which we have no control. We are not responsible for the availability, accuracy, or legality of data provided by third-party sources.
• Rate Limits & Access: We reserve the right to limit, restrict, or revoke access to Lookup Services at any time, for any reason, including suspected abuse or misuse.

13. Indemnification

You agree to defend, indemnify, and hold harmless Moan Bot, its operators, affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable legal fees, arising out of or in any way connected with your access to or use of the Services or your violation of this Agreement.
